Defense lawyers for LtCol Jeffrey Chessani believe all charges may be dropped. They base
this on a signal from the military judge, Col Folsom, who previously scheduled a hearing for two days and has now changed the session to last one hour. At this session the military judge will rule on the motion to dismiss based on undue command influence.
Not too fast. Even if the military judge finds undue command influence it does not mean that he will dismiss the charges with prejudice. Thus, the charges could be brought again. The government, however, would have to start from square one and conduct another Article 32 investigation. If, however, the military judge dismisses the charges with prejudice, the case would end and LtCol Chessani could not be charged again.
